Waiting for payment or enforcing eviction is costly. Either of these options allows the arrears to escalate. Eviction may provoke some tenants to damage the property, leaving it uninhabitable.

Marston Group offers the following options to achieve a successful outcome:

Marston Group can recover an outstanding debt on behalf of a landlord through the County Court and High Court.

How to obtain a County Court Judgment (CCJ): Once a tenant falls into arrears (as early as 1 day), a CCJ should be obtained immediately to avoid further escalation of debt. Providing the value of the debt is greater than £600 (including costs), a CCJ can be obtained from www.moneyclaim.gov.uk. Alternatively, we offer a Transfer Up Service through our partner solicitors, at no cost to our clients. The only payment required is a £50 cheque for the fee charged by the court for issuing the Writ.

How to obtain a High Court Writ: Providing the arrears are £600 or more (including costs), we will transfer your CCJ to the High Court, together with your payment of £50 (payable to Her Majesty's Courts Service (HMCS). We will manage the process at no cost to you.

Where we recover monies, our services are free of charge. If Marston Group fails to recover any money or seize any assets, a fee of £60 + VAT is payable by the client.
