Accessibility

Accessing our service could not be easier; all you need is a sealed court writ. Forward your Writ of Fi Fa to our High Court Enforcement Centre.

Debts over £15,000

Debts over £15,000 can be directed straight to the High Court, as there is no need for a CCJ, however you will need to appoint John Marston as your chosen authorised High Court Enforcement Officer, to ensure your writ is passed to Marston Group to enforce.

What happens next?

Once a sealed writ is received, a High Court Enforcement Officer (HCEO) is instructed to attend the stated address. Initial contact will be made by personal attendance to the address. It is important that judgment debtors are not provided with an opportunity to dissipate or hide their assets in advance of our attendance.

If payment is not forthcoming our HCEO's are legally able to seize the judgment debtor's goods in order to secure payment.

REISSUES AND RENEWALS

Are we currently enforcing a writ for you, and is it due to expire shortly?

To continue enforcement, send a request to renew the writ to our Transfer-Up Department. The request should consist of a letter expressing your intention to renew and a cheque for £45 payable to Her Majesty's Courts Tribunal Service to cover the court fee. Please include our reference number and the parties involved. We will arrange for a current statement and a copy of the writ to be sent to our partner solicitors.

Have you previously instructed us to enforce a writ that has now expired?

To enforce a judgment following an expired writ, send a request to reissue to our Transfer-Up Department. The request should consist of a letter expressing your intention to reissue, the original N293A Certificate of Judgment (if available) and a cheque for £60 payable to Her Majesty's Courts Tribunal Service to cover the court fee.

Please include our reference number and the parties involved. We will arrange for a current statement and a copy of the writ to be sent to our partner solicitors.

Would you like to continue enforcement of a writ unsuccessfully or partially satisfied by a different HCEO?

To continue enforcement through Marston Group send your reissue request to our Transfer-Up Department. This should consist of a letter expressing your intention to reissue, a copy of the original judgment, the Certificate of Judgment, the original writ, a formal return from the HCEO or Sheriff plus a cheque for £60 payable to HMCS.

Scottish & Foreign Matters

Do you have a Scottish or Foreign judgment, Order or Decree for enforcement in England or Wales?

To enforce your Scottish Order against a defendant that resides in England or Wales, send the original certificate (Form 1), a photocopy of your order and a cheque for £60 payable to Her Majesty's Courts Tribunal Service to cover the court fee to our Transfer-Up Department.

Subject to relevant legislation and treaties, and provided that the defendant is residing in England or Wales, Marston Group is authorised to issue and execute a writ to enforce an order, judgment or decree given in any country outside the UK.
