Marston Group welcomes Employment Tribunal award announcement
Marston Group welcomes the Justice Minister's announcement that, from 6 April 2010, High Court Enforcement Officers (HCEOs) can be directly commissioned by successful tribunal applicants to enforce their Employment Tribunal award or settlement. This reflects a desire to increase the proportion of individuals recovering monies due to them from successful tribunal actions. Research published by the Ministry of Justice in May 2009 showed 39% of people granted awards by tribunals had not been paid and only 53% were paid in full.
Under the previous system, employees had to obtain a County Court Judgment by completing N322A and B forms. A judgment would then be issued and transferred to the High Court for enforcement. The streamlined process will combine both forms into a single document, and will allow HCEOs to use the new certificate to directly issue a Writ of Fifa.
John Marston OBE, Group Chairman, commented: "We are delighted to be able to offer faster, more effective enforcement of Employment Tribunal awards, and can now offer a dedicated, enhanced service. We will assist applicants to complete the court processes and will seek to recover amounts due to them as quickly and efficiently as possible."
